1. About SiteWinds
SiteWinds is a real-time wind data companion app for coastal and inland sites. It is built for a broad range of wind-reliant activities, including paragliding, hang gliding, gliding and RC model aircraft flying.
SiteWinds is not a certified aviation weather service, a flight planning tool, or a substitute for any official pre-flight weather briefing. It is an informational reference only and must be treated as such at all times.
2. Eligibility and Acceptance
By using SiteWinds, you confirm that:
- You are at least 16 years old, or you are under 16 and have obtained verifiable consent from a parent or legal guardian in accordance with the Australian Privacy Act 1988
- You accept these Terms in full
- You will use the app lawfully and in compliance with all applicable regulations
- You have the knowledge, experience, and qualifications required for the activity you are undertaking, and you accept full personal responsibility for any decisions you make in connection with that activity
3. License and Permitted Use
3.1 App License
We grant you a limited, non-exclusive, non-transferable, revocable license to use SiteWinds for personal, non-commercial use.
3.2 Restrictions
You agree not to:
- Reverse engineer or tamper with the app
- Use the app to violate laws or third-party rights
- Redistribute, resell, or repackage the app without permission
4. Weather and Site Information Disclaimer
SiteWinds aggregates weather data from third-party station providers and services. Readings may be real-time or near real-time depending on provider update frequency. Data may be delayed, stale, incomplete, inaccurate, or entirely unavailable at times due to station faults, connectivity issues, or provider outages.
SiteWinds is an informational tool only and must never be used as the sole or primary basis for any flying, activity, or safety decision. Wind conditions can change rapidly and without warning. Data shown in the app may not reflect current or forecast conditions at your specific location or altitude.
Before undertaking any aviation or wind-reliant activity, you must independently assess conditions using official and certified sources, including but not limited to official aviation weather briefings, NAIPS, ATIS, METAR, TAF, and any other sources required by the applicable regulations or your aircraft's operating limitations. SiteWinds data does not satisfy any regulatory pre-flight briefing requirement.
5. Regulatory Compliance
You are solely responsible for complying with all applicable laws, regulations, and rules governing your activity, including but not limited to:
- All Civil Aviation Safety Authority (CASA) regulations applicable to your aircraft category and operation
- Airspace restrictions, NOTAMs, and controlled airspace requirements
- Any site-specific rules imposed by landowners, clubs, or governing bodies
- State and territory laws applicable to your activity
SiteWinds does not provide regulatory guidance, airspace information, or NOTAM services. Nothing in the app should be construed as authorisation or clearance for any flight operation.
6. No Warranty
SiteWinds is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of fitness for a particular purpose, merchantability, availability, reliability, timeliness, and data accuracy. We do not warrant that the app will be error-free, uninterrupted, or that any data shown is current, complete, or accurate.
7. Limitation of Liability
To the maximum extent permitted by law (including the Australian Consumer Law), we are not liable for any loss, damage, injury, death, or claim of any kind arising from or in connection with your use of SiteWinds or reliance on any data it provides, including:
- Personal injury or death resulting from any flying or wind-reliant activity
- Damage to aircraft, equipment, or property
- Indirect, incidental, special, consequential, or exemplary damages
- Losses caused by inaccurate, delayed, stale, or unavailable weather data
- Missed weather windows or activity opportunities
- Any safety outcome arising from a decision made with or without reference to the app
Where liability cannot be excluded by law, our total liability is limited to the amount you paid for the app or subscription in the 12 months preceding the claim, or AUD $10, whichever is greater.
8. Third-Party Services
SiteWinds relies on third-party services including analytics and weather data providers. Their availability, accuracy, and policies are outside our control, and we accept no responsibility for their data or service interruptions.
Weather readings shown in SiteWinds include data from providers such as WillyWeather (including data supplied by the Bureau of Meteorology), Holfuy, FreeFlight Wx, and selected community or club station feeds. Site information uses data from the Australian National Site Guide. Attribution links are provided in-app where station data is shown.
9. No Advertising
SiteWinds is entirely ad-free. The app does not display advertisements, does not use advertising SDKs, and does not collect or share data for advertising or ad-targeting purposes. SiteWinds is funded exclusively through subscriptions.
10. Subscription, Free Preview, and Free Trial
SiteWinds requires an active subscription ("SiteWinds Pro") to access the full app experience, including live wind data, wind particle overlays, site information, bookmarks, forecasts, and live location display on the map.
10.1 Free Preview Period
New users receive a 3-day free preview of the full app starting from the first launch. During this preview period, all features are available without a subscription. After the preview expires, the app enters a limited mode where only Settings and the Subscribe screen remain accessible until a subscription is activated.
10.2 Free Trial
SiteWinds Pro includes a 1-month free trial for eligible new subscribers. The free trial is offered through the Apple App Store or Google Play Store. If you do not cancel before the trial ends, your subscription will automatically convert to a paid annual (1-year) subscription at the standard renewal price.
10.3 Billing and Payments
- Billing and Payment: Payment will be charged to your Apple ID or Google Play Account at confirmation of purchase (or at the end of any free trial period).
- Auto-Renewal: Subscriptions automatically renew annually at the same price as the original plan unless auto-renew is turned off at least 24 hours before the end of the current billing period.
- Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period, identifying the cost of renewal.
- Managing Subscriptions: You can manage your subscription and turn off auto-renewal by going to your App Store or Play Store Account Settings after purchase.
- Cancellation and Refunds: You can cancel your subscription at any time. Cancellations apply to the next billing cycle; you retain access until the end of the current paid period. All payments are processed through the mobile platform store, and any refunds must be requested directly from Apple or Google in accordance with their respective policies.
11. Privacy
Your use of SiteWinds is also governed by our Privacy Policy.
12. Changes to the App and Terms
We may modify, suspend, or discontinue app features, and may update these Terms over time. Continued use of the app after updates constitutes acceptance of the revised Terms.
13. Termination
We may suspend or terminate access to SiteWinds for misuse, abuse, or conduct that harms the app or other users.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of New South Wales, Australia. In the event of any dispute arising out of or in connection with these Terms or your use of SiteWinds, the parties agree to first attempt resolution in good faith through direct communication. If the dispute cannot be resolved informally within 30 days, it shall be submitted to the exclusive jurisdiction of the courts of New South Wales, Australia.

16. Mobile Application Platform Minimum Terms (EULA)
If you downloaded SiteWinds from the Apple App Store or Google Play Store, you acknowledge and agree to the following minimum platform terms:
- Acknowledgment: This agreement (EULA) is concluded solely between you and the Developer (Sami Ercan), not Apple, Inc. or Google LLC. Developer, not Apple or Google, is solely responsible for the App and its content.
- Scope of License: The license granted to you is a non-transferable license to use the App on Apple-branded or Android-compatible devices that you own or control, and as permitted by the Usage Rules set forth in the App Store Terms of Service or Google Play Terms of Service.
- Maintenance and Support: Developer is solely responsible for providing any maintenance and support services for the App. Apple and Google have no obligation whatsoever to furnish any maintenance and support services for the App.
- Warranty: Developer is solely responsible for any product warranties, express or implied. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple or Google for a refund of the purchase price. To the maximum extent permitted by applicable law, Apple and Google will have no other warranty obligation whatsoever.
- Product Claims: Developer, not Apple or Google, is responsible for addressing any claims you or any third party may have relating to the App, including product liability claims, regulatory compliance claims, and consumer protection claims.
- Intellectual Property Rights: In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Developer, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such infringement claim.
- Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-Party Beneficiary: Apple, Google, and their respective subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of these Terms, Apple and Google will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
